Civil Matters - FAQs
Can we settle out of court?
Absolutely, and we often encourage this approach. Many of our cases are settled before trial. It's usually faster, cheaper, and less stressful.
Should I accept their settlement offer?
That's a personal decision, but we'll help you evaluate it and provide expert advice. Let's look at your likely outcome at trial, the costs involved, and the time factor. Remember, a settlement means certainty and closure, while litigation carries risks but might yield better results.
What if the other party isn't following the court order?
We have several enforcement options in South Africa. We can file a contempt of court application, use the sheriff to attach property, or garnish wages. We'll help you choose the most effective approach for your situation.
What information should I avoid sharing on social media?
Please don't post anything about your case online. Even seemingly innocent posts can be used against you. If you're unsure about something, rather send it to me first to review. Think of social media as a public courtroom.
Can I speak to the Magistrate/Judge directly?
No, all communication must go through proper legal channels. I know this can be frustrating, but it protects the integrity of the process. We'll make sure your voice is heard through the appropriate means.
What if I receive documents from the other party's lawyer?
Please forward them to me immediately without responding. Even a well-intentioned response could complicate matters. I'll review them and advise you on the next steps.
